As the second most populous country in the world, India has also been affected by the transformation of the online gambling industry.

Several factors have driven the popularity of online gambling, the most prominent being technological advancements and the boom in digital payments. These changes have given players almost seamless access to a whole new realm of opportunities.

Although online gambling is widely accepted and practiced in many countries, it is still in its infancy in India. Nevertheless, the universal appeal of gambling is undeniable, as an ever-growing number of people are wagering on casino games, and the industry’s revenue figures prove it.

Although the situation in the country remains somewhat perplexing, numerous gaming operators are embracing the flourishing market and doing their best to keep gambling aficionados engaged.

The aim of this article is to help you gain insight into the legal landscape in the country and provide the knowledge you need so you do not feel overwhelmed when choosing an online casino to play at.

Gambling Legislation in India

Gambling Legislation imageBefore casino enthusiasts start picking an online casino worthy of their time and money, they should make sure they fully understand the current gambling climate.

The legality of certain forms of gambling has been the subject of heated debate for quite some time, largely because many people consider the country’s legislation outdated. Interestingly, the most important laws governing gambling are the Public Gambling Act of 1867 and the Prize Competitions Act of 1955. India’s constitution, however, allows individual states to draft laws on gambling and betting on their own, further complicating the situation.

The legal landscape is challenging because, while some states adopted the Public Gambling Act, others enacted their own legislation, as is the case with Maharashtra, Sikkim, Tamil Nadu, and Rajasthan, among others. The primary purpose of the act, however, was to outlaw public gambling and outline the penalties for offenders.

Interpreting and applying these laws is difficult because they were enacted long before the rise of online gambling. Moreover, the Act does not define what gambling is, leaving room for varied interpretations.

The Prize Competitions Act of 1955 was not a game changer either, as its provisions are very general. It simply states that competitions offering prizes worth more than 1,000 rupees per month are prohibited.

Indian legislation differentiates between games of skill and games of chance, a distinction players must understand because the country has banned games of chance. Determining which casino games rely on skill rather than luck can be contentious. Consequently, the Cable Television Network Rules of 1994 prohibit advertising all gambling activities except games that require skill.

Players should also keep the Foreign Exchange Act of 1999 in mind. When gambling at an online casino that does not support payments in rupees, players may have to use another currency, which could be considered a currency exchange and may create complications. This is best avoided.

The Information Technology Act of 2011 is another relevant statute because it prohibits Internet and network service providers from transmitting any content that may incite citizens to gamble. In practice, however, this legislation has not been very effective, as online casinos continue to operate largely unchallenged by the government.

How to Identify Unsafe India-friendly Online Casinos

Currently, Sikkim and Nagaland are the only states that have enacted legislation specifically addressing online gambling. The Sikkim Online Gambling Act, passed in 2008, aims to allow casino games such as roulette, blackjack, poker, bingo, baccarat, brag, and keno, among others. Sports betting is also covered, and citizens of Sikkim may wager on sporting events provided the operator holds a state license.

The Act further stipulates that all forms of electronic gambling are subject to taxation.

Nagaland’s approach differs slightly because it offers a clear definition of gambling. The Nagaland Prohibition of Gambling and Promotion and Regulation of Online Games of Skill Act of 2015 defines gambling as wagering solely on games that rely on luck rather than skill.

In the western Indian state of Goa, casino gaming is not completely prohibited. Residents may play casino games in five-star hotels and aboard certain vessels.

Telangana is one of the few states whose legislation explicitly states that its citizens are prohibited from wagering online or offline. The state describes gambling as a menace that jeopardizes public welfare. Although the Telangana Gambling Act of 2017 is said to violate the country’s constitution, the courts have not yet ruled on the matter.

Bonuses and Exclusive Deals Players from India Can Benefit from

bonuses imageMost India-facing online casinos put considerable effort into keeping their players engaged, both to retain existing customers and attract new ones. Operators realize that while their game portfolio is the heart of the casino, the importance of promotional offers should not be underestimated as well.

Most operators targeting the market have already found their stride in meeting the needs of new and returning users. Many even cater specifically to Indian players by offering exclusive deals in rupees.

In most cases, sign-up offers are the most enticing because they give newcomers free funds right from the start. Indian players can expect deposit matches, bonus spins, or even cashback deals.

If you are an experienced gambler, you already know to look beyond the sign-up offer when choosing an online casino. Players are usually offered various exclusive deals later on, designed to make their long-term experience more rewarding. These may include reload, no-deposit, referral, and payment-method bonuses. Players may also find game-specific promotions and daily or monthly deals.

Some operators also allow players from India to compete in various tournaments, giving them the chance to win even larger prizes. Loyalty schemes are another effective way to build momentum while playing online.

The majority of web-based casinos that accept players from the region eventually grant access to their VIP programs, provided players have been active for some time and accumulated a certain number of loyalty points. Benefits can include dedicated customer support, tailored promotions, gifts, and birthday bonuses.

Many players are so dazzled by these perks that they forget to determine whether the promotional offer is worthwhile at all. Operators compete to offer eye-catching bonuses, but there is no such thing as a free lunch, so reading the bonus terms and conditions is essential.

Playing Casino Games on the Go

mobile games imagePlayers who are on the move and cannot wait to get home to play will not be disappointed. Most casinos that cater to Indian players have responded to the rapidly growing popularity of mobile gambling by providing dedicated apps for touchscreen devices or browser-based apps.

Many players are drawn to mobile gambling because, in most cases, mobile casinos are feature-rich and offer a wide selection of games. Some operators even provide exclusive deals tailored to mobile users, making their sites especially appealing.

Mobile gambling is popular in the region because players can enjoy their favorite games and potentially secure big payouts in a convenient way. At most virtual casinos targeting the market, no additional software is required; you simply visit the casino’s website through your browser to start playing.

Another advantage of gaming websites that offer in-browser apps is that they do not use any storage space, which is especially appealing if you do not want to commit to a single mobile casino.

A hallmark of a good mobile casino is a well-designed user interface. Many mobile casinos remove unnecessary frills to ensure smooth, stress-free navigation and an excellent user experience.

Have any other states in India legalized online casinos for their state residents?

Asked by: Alvin | Asked on: 2023-06-11
Answered by: Dan | Answered on: 2023-06-12

At the time of writing, most Indian states rely on outdated laws to regulate gambling, so no specific statutes address online gambling. That said, Nagaland, Meghalaya, and Sikkim have adopted more modern legislation that regulates online gambling and permits certain virtual skill or sports games. Sikkim and Meghalaya have legalized online games and sports games, but they must be offered only through an intranet system that excludes residents of other Indian states. Nagaland, meanwhile, has introduced a framework that regulates online skill games while excluding any products considered gambling.

I saw there has been a bill proposed to ban online gambling in Tamil Nadu. What does that mean for online casino players from the state?

That’s right. In April 2023, Tamil Nadu Governor R. N. Ravi approved a long-pending gambling ban bill. The bill covers online rummy and real-money poker, both of which are popular among players in the state. Currently, the ban applies only to these two games, but there have been suggestions to include other online games and fantasy sports. A multi-member committee has been tasked with reviewing all other forms of online gambling, including fantasy sports, and deciding whether they should also be added to the Online Gambling and Regulation of Online Games Bill. For now, the only forms of online gambling banned in Tamil Nadu are rummy and poker.
